Fizzie Republic Threatens Legal Action Over Unauthorized Use Of ‘P3’ Campaign Displays In Ibadan
Frizzle Republic has threatened legal action over what it described as the unauthorised use of its Portrait Pole Post, P3, advertising format in campaign displays deployed by the Allied Peoples Movement, APM, in parts of Ibadan.
The creative advertising organisation, in a statement signed by Fashogbon Abiodun David, whom it identified as the copyright owner of the P3 concept, alleged that campaign displays associated with APM’s Seyi Makinde and Bimbo Adekanmbi reproduced its advertising format without permission.
Fizzie Republic said it did not grant the campaign organisation any licence or consent to use the P3 format and was not consulted before the displays were mounted across parts of the Oyo State capital.
The organisation said its concern was not with the campaign activities themselves but with what it described as the unauthorised adoption of its creative advertising format.
It urged the campaign organisation and other parties involved to regularise the use of the format, warning that it would have “no option than to take legal action against the infringers” if the matter was not resolved.
Fizzie Republic said it wished the campaign organisation well but insisted that appropriate licensing procedures should be followed where its Portrait Pole Post format is used.
The company also said it had photographic evidence of the disputed campaign displays attached to its statement.
The development raises questions over whether the campaign displays merely employ a commonly used outdoor advertising arrangement or reproduce distinctive creative elements that Fizzie Republic claims ownership of under its P3 concept.
As of the time of the statement, there was no response from the APM campaign organisation addressing the allegation or explaining the basis on which the disputed displays were deployed.
