CONGRESS: Adanla’s Case Against Oyo APC Adjourned Till June 21

    The Federal High Court sitting in Ibadan, Oyo state capital has adjourned sitting on a case filed before Hon. Justice Uche Nma Agomoh till Tuesday 21st of June, 2022 for hearing on a matter brought before it by a chieftain of the All Progressives Congress, APC, in Oyo state, Alhaji Kayode Adanla against the leadership of the party at the national level, the Independent National Electoral commission (INEC), the Oyo state chapter of the APC, its chairman— Mr Issac Omodewu and five others as co- defendants.

    The suit marked FHC/IB/CS/56/2022 is asking the court to among other things look into the controversies surrounding the election, appointment and composition of executive members of the first defendant in it’s Oyo state chapter which was fraught with gross disenfranchisement and marred by irregularities thereby infringing on the fundermental human right of the applicant whose name was unilaterarily removed from the list of it’s executive members with reckless abandon without due reverence to the constitution of the 1st defendant against the spirit and letters of the 1999 constitution as ammended amongst other reliefs sought from the court.

    Also, the applicant filed an application for an order of injunction restraining the respondents particularly the 3rd, 6th, 7th & 8th respondents from parading themselves as chairman and members of the first respondent in Oyo state pending the determination of the substantive suit along with other members of the Oyo state chapter of the 1st defendant.

    Learned counsel to the claimant, Olusola Sullyman in his address urged the court to proceed on the matter as all parties involved have been served with originating summons and other necessary documents.

    He stated further that his client who is being unjustly treated in the matter before the honourable court is favourably disposed to commencement of proceedings as he is present in court and ready to proceed with the matter.

    Counsel to the 1st defendant who is also representing the 3rd to 8th defendants in the matter, Mohammed Deji Abdulsalam while applying to the court for an adjournment sought the relief of the court to allow him file necessary processes to respond to the applicants claim.

    In her ruling, Hon. Justice Uche Nma Agomoh ordered counsel to the applicant to ensure service of all processes on all the defendants in their known addresses in Abuja and their counsel and that proof of service should be made available to the court, while also ruling that the court will determine the jurisdiction or otherwise of the court to entertain the matter.

    The claimant/applicant who is a bonafide and registered member of the All Progressives Congress in Oyo state, Alhaji Kayode Adanla is approaching the court to determine whether the first defendant along with his officials were right to have removed his name from the list of validly elected officials of the party who were validly elected at the state Congress of the first defendants Oyo state chapter which held at the Liberty stadium on the 30th of October, 2021 where he was unanimously elected and retuned as the state organizing secretary of the party in the said election.
